Terms of Service & Licensing

Institutional licence agreement for schools, educators, and curriculum partners.

1. Institutional Subscription & Scope

By accessing or utilising Inkcraft Studio, Inkcraft Report, or any software tools supplied by Inkcraft Education Pty Ltd ("Inkcraft"), your school, educational institution, or individual user agrees to be bound by these Terms of Service.

Inkcraft grants subscribing Australian schools and individual educators a non-exclusive, non-transferable, revocable licence to access the following platforms:

Inkcraft Studio: Educational assessment, diagnostic testing, and curriculum analytics engineered for Victorian Curriculum 2.0 and Australian Curriculum (ACARA v9).
Inkcraft Report: School report comment proofreading, zero-deficit moderation, and 1-click SIS clipboard formatting calibrated to VCAA, NESA, and ACARA frameworks.

2. Subscription, Fees & Renewal

Inkcraft Studio (School Subscription)

Inkcraft Studio is licensed on a 12-month institutional subscription basis.
Subscriptions typically commence at the beginning of the school year. Mid-year sign-ups are pro-rated for the remaining subscription period.
Pricing is determined on a school-by-school basis and provided upon consultation. Please contact us for a quote.
Payment is by institutional invoice unless alternative arrangements (including Stripe) are agreed in writing.

Inkcraft Report (Individual & School Subscription)

Inkcraft Report is available as an individual teacher subscription via in-app purchase (processed securely by Stripe).
Individual subscriptions run for 12 months from the date of purchase.
Whole-school pricing is available upon request. Please contact us for institutional pricing.

AI Credits & Add-On Pricing

Institutional and school subscriptions include complimentary AI credit allowances calibrated to your cohort size or service tier.
Additional AI credit top-up packages may be purchased by subscribing institutions at prevailing rates published on the platform or quoted on an official institutional purchase order.
Year-to-Year Rate Adjustments: Pricing for additional AI credit packages and top-up bundles is subject to periodic and annual review, and may adjust from year to year (effective at the commencement of each school calendar or subscription renewal year) to account for shifting foundational AI model, token processing, and infrastructure expenses.
Rollover & Protection of Existing Balances: Rate adjustments apply strictly to subsequent top-up purchases. Any unused credits previously allocated or purchased remain in your school's account and do not expire while an active subscription is maintained. Inkcraft does not impose automatic overage charges or retroactive rate increases on active credit balances.

Inkcraft Education reserves the right to adjust subscription pricing and AI credit unit rates for future subscription periods or top-up purchases with at least 30 days' written notice to the subscribing school or individual. Price changes do not apply to active subscription terms or existing credit balances.

3. Intellectual Property & Curriculum Attribution

All software interfaces, branding, proprietary WebAssembly client engines, vector icons, AI proofreading models, and diagnostic algorithms are the exclusive property of Inkcraft Education Pty Ltd.

Victorian Curriculum 2.0 Attribution: Content mapping references standard descriptors published under the Victorian Curriculum and Assessment Authority (VCAA). Inkcraft software aligns with VCAA standards to support Victorian educators.

Australian Curriculum (ACARA v9) Attribution: Inkcraft Studio aligns directly with the Australian Curriculum Version 9 published by the Australian Curriculum, Assessment and Reporting Authority (ACARA). All curriculum codes (e.g., AC9E, AC9M, AC9S, AC9H), substrands, and achievement standards are referenced to support educators across participating Australian states and territories. ACARA does not endorse or sponsor Inkcraft software.

4. Acceptable Use

Users and subscribing schools agree not to:

Attempt to reverse-engineer, decompile, or extract proprietary client-side diagnostic algorithms.
Sublicense, resell, or distribute assessment content to non-subscribing external commercial entities.
Upload malicious code, automated bots, or data scrapers to the platform.
Submit non-educational or inappropriate content to Inkcraft Report's AI proofreading system.

5. Service Availability & SLA

Inkcraft Studio is a cloud-hosted service and requires an active internet connection. We maintain a target uptime SLA of 99.9% for our Australian-hosted infrastructure (Fly.io, Sydney) to ensure reliable access to core student practice and test administration.

Inkcraft Report, as a cloud-hosted service, maintains a target uptime SLA of 99.9% for its Australian-hosted infrastructure. Availability of the AI proofreading feature is additionally dependent on third-party AI provider uptime.

6. Warranty Disclaimer

Inkcraft Education provides its software platforms on an "as is" and "as available" basis. To the maximum extent permitted by Australian Consumer Law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we endeavour to ensure assessment content aligns with published curriculum frameworks, Inkcraft Education does not guarantee that all content is error-free, complete, or current. AI-generated suggestions provided by Inkcraft Report are advisory only and should be reviewed by the educator before use.

7. Limitation of Liability

To the maximum extent permitted by law, Inkcraft Education's total aggregate liability for all claims arising out of or relating to these Terms or the use of our platforms shall not exceed the total fees paid by the subscribing school or individual to Inkcraft Education during the twelve (12) months immediately preceding the claim.

In no event shall Inkcraft Education be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or interruption of educational services, regardless of the cause of action or the theory of liability.

8. Termination

Subscriptions to Inkcraft Studio and Inkcraft Report run for their stated 12-month term and do not automatically renew unless agreed in writing.

Termination by Subscriber: Schools and individual users may choose not to renew at the end of their subscription period. No refunds are provided for early cancellation of an active subscription term, except as required by Australian Consumer Law.
Termination by Inkcraft: Inkcraft Education may suspend or terminate a user's access immediately if the user materially breaches these Terms or the Acceptable Use Policy.
Effect of Termination: Upon termination, schools should export any required data prior to the end of their subscription. Inkcraft Education will securely decommission and destroy the school's dedicated cloud database within 90 days, in accordance with our Data Retention Policy.

9. Data Portability & Export

Subscribing schools retain full ownership of their institutional data. Prior to the end of a subscription term or termination, schools may export their assessment data, student records (in anonymised or identified form), and curriculum mappings from Inkcraft Studio using the platform's built-in export functionality. Inkcraft Education will provide reasonable assistance to facilitate data export upon request.

10. Free Trials & Pilot Programs

Inkcraft Education may offer free trial or pilot access to schools on a case-by-case basis at our sole discretion. Pilot terms, duration, and scope are defined in separate written agreements between Inkcraft Education and the participating institution. Unless otherwise agreed in writing, all general Terms of Service apply during pilot periods.

11. Force Majeure

Inkcraft Education shall not be liable for any failure or delay in performing its obligations where such failure or delay arises from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions or restrictions, internet or telecommunications failures, power outages, cyberattacks, or actions of third-party service providers.

12. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia.

In the event of any dispute arising under these Terms, the parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may refer the matter to mediation administered by the Resolution Institute (or an equivalent Australian mediation service) before commencing litigation. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of the State of Victoria, Australia.
